These Terms of Service govern your use of Viqus.ai. We've written them in plain language so you understand your rights and our obligations — no legalese traps.

Section 01

Acceptance of Terms

By accessing or using the website located at viqus.ai (the "Website" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Website.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Viqus.ai ("Viqus," "we," "us," or "our"). They apply to all visitors, users, and subscribers of the Service.

We may update these Terms from time to time. For material changes, we will provide at least 30 days' advance notice via a prominent announcement on the Website before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you disagree with any changes, you should stop using the Service before they take effect.

Important for EU Consumers

If you are a consumer resident in the European Economic Area (EEA) or the United Kingdom, nothing in these Terms affects your mandatory statutory rights under applicable consumer protection law, including Directive 2011/83/EU (Consumer Rights Directive) and national implementing legislation. In the event of conflict between these Terms and mandatory consumer law, the consumer law prevails.

Definitions

Throughout these Terms, the following terms have the meanings set out below:

  • "Content" means all text, articles, analyses, scores, graphics, software, data, and other material published on or generated by the Website, including AI-generated summaries, Viqus Verdict scores, and editorial commentary.
  • "User Content" means any information you submit to us, such as email addresses for newsletter subscription, contact form messages, or feedback.
  • "AI Analysis" means the automated processing of third-party news articles through our local AI models (via Ollama) to produce summaries, impact scores, and contextual insights.
  • "Newsletter" means the periodic email communications containing curated AI news and analysis sent to subscribers who have opted in.
  • "Personal Data" has the meaning given under the EU General Data Protection Regulation (Regulation (EU) 2016/679).
  • "Consumer" means any natural person acting for purposes outside their trade, business, craft, or profession.
Section 03

Description of the Service

Viqus.ai is an AI-powered news analysis platform focused on the artificial intelligence industry. The Service includes:

  • AI News Aggregation & Analysis: We collect publicly available news articles from third-party sources and process them through our proprietary AI analysis pipeline to generate summaries, relevance scores (Media Hype and Real Impact), and a combined Viqus Verdict.
  • Educational Resources: The Viqus Academy, AI Glossary, and other learning materials designed to make AI technology accessible.
  • Newsletter: A weekly email digest of the most significant AI developments, available by opt-in subscription.
  • Tools & Labs: Experimental features including CLI tools and other utilities, which may be subject to additional terms.

The Service is provided free of charge. We reserve the right to introduce premium features in the future, which would be subject to separate terms and explicit consent before any charges apply.

We make reasonable efforts to keep the Service available and up to date, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. For significant changes that affect your use, we will provide reasonable advance notice where practicable.

Section 04

Eligibility & Age Requirements

You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) to use the Service. For users in the United States, the minimum age is 13 years old, in accordance with the Children's Online Privacy Protection Act (COPPA).

By using the Service, you represent and warrant that you meet the applicable age requirement. If we learn that a user does not meet these requirements, we will take steps to delete any personal data collected and restrict access to the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Section 05

Newsletter & Email Subscriptions

When you subscribe to our Newsletter, you consent to receiving periodic email communications from Viqus.ai containing AI news, analyses, and updates.

  • Opt-in: Newsletter subscription is entirely voluntary and based on your explicit consent.
  • Unsubscribe: Every email contains an unsubscribe link. You may also request removal by emailing privacy@viqus.ai. We will process unsubscribe requests within 48 hours.
  • Data use: Your email address is used solely for delivering the Newsletter. We do not sell, share, or use it for unrelated purposes. Please see our Privacy Policy for full details.
EU / EEA Subscribers

In compliance with the ePrivacy Directive (2002/58/EC) and GDPR, we only send marketing emails after obtaining your prior, explicit, freely given consent. You may withdraw consent at any time, and we will cease sending communications without undue delay.

Section 06

Intellectual Property

All Content on the Website — including but not limited to text, AI analyses, Viqus Verdict scores, graphics, logos, icons, images, code, software, and the overall design and look-and-feel — is the property of Viqus.ai or its licensors and is protected by copyright, trademark, and other intellectual property laws.

What you may do:

  • Access, read, and share links to our Content for personal, non-commercial purposes.
  • Quote short excerpts of our Content with proper attribution (linking to the original article on viqus.ai).

What you may not do:

  • Reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit our Content without prior written permission.
  • Use automated tools (scrapers, bots, crawlers) to systematically access or extract Content from the Website, except for standard search engine indexing.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
  • Frame the Website or use meta-tags or hidden text that incorporate our trademarks.

Third-Party Content: Some articles analyzed on Viqus.ai originate from third-party news sources. We provide AI-generated summaries and analysis; the original articles remain the intellectual property of their respective publishers. Links to original sources are provided for reference.

Trademark: "Viqus," "Viqus.ai," the Viqus logo, and "Viqus Verdict" are trademarks of Viqus.ai. Use of these marks without authorization is prohibited.

Section 07

Acceptable Use & Prohibited Conduct

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by, any third party. Specifically, you agree not to:

  • Use the Service for any illegal, fraudulent, or unauthorized purpose.
  • Attempt to gain unauthorized access to any part of the Service, other users' data, or our systems and networks.
  • Introduce malware, viruses, or any other harmful code to the Website.
  • Engage in any activity that interferes with or disrupts the Service or the servers and networks connected to it.
  • Use the Service to collect, harvest, or aggregate Personal Data of other users.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the AI analyses provided by Viqus to generate competing commercial products without authorization.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision, including restricting access to the Service. For EU consumers, any enforcement action will be proportionate and reasoned, and you will be notified of the grounds for such action.

AI-Generated Content Disclaimer

Viqus.ai uses locally hosted artificial intelligence models (via Ollama) to analyze, summarize, and score news articles. You acknowledge and agree that:

  • AI limitations: AI-generated content, including summaries, scores, and analyses, is produced automatically and may contain inaccuracies, omissions, or biases inherited from the underlying data or models.
  • Not professional advice: Our Content is for informational and educational purposes only and does not constitute financial, investment, legal, medical, or any other form of professional advice.
  • No endorsement: The inclusion of any news article or topic in our analysis does not imply endorsement of the views, products, or services mentioned therein.
  • Verification: You should independently verify any information before making decisions based on our Content, and consult qualified professionals where appropriate.
  • Transparency: All AI-generated scores (Media Hype, Real Impact, Viqus Verdict) are clearly labeled. Our methodology is published and available in the Viqus Academy.
Automated Decision-Making Disclosure

In accordance with GDPR Article 22 and the EU AI Act, we disclose that Viqus Verdict scores are produced by automated processing without human review of individual scores. These scores are informational only and are not used to make decisions that produce legal or similarly significant effects on any individual. No profiling of individual users takes place.

Section 09

Privacy & Data Protection

Your privacy is fundamental to how we operate. Our collection and use of Personal Data is governed by our Privacy Policy, which forms an integral part of these Terms. Key points include:

  • We comply with the EU General Data Protection Regulation (GDPR), the California Consumer Privacy Act as amended by CPRA (CCPA/CPRA), and other applicable data protection laws.
  • All AI processing runs on our own infrastructure via Ollama. No user data is sent to third-party AI providers.
  • We collect the minimum data necessary to operate the Service.
  • We do not sell your Personal Data.
  • You have the right to access, correct, delete, and port your data, and to object to or restrict its processing.

Section 10

Disclaimers of Warranties

To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The Content, including AI-generated analyses and scores, will be accurate, complete, reliable, or current.
  • Any defects in the Service will be corrected.
  • The Service will be free from viruses or other harmful components.
EU Consumer Protection Notice

If you are a consumer in the EEA or UK, these disclaimers do not affect your mandatory statutory rights under the Consumer Rights Directive (2011/83/EU), the Digital Content Directive (2019/770/EU), or equivalent national legislation. Under EU law, digital content must conform to the contract, be fit for purpose, and meet reasonable quality expectations. Where the Service does not meet these standards, you are entitled to the remedies provided by applicable consumer law.

Section 11

Limitation of Liability

To the maximum extent permitted by applicable law, Viqus.ai, its operators, affiliates, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or in connection with:

  • Your use of, or inability to use, the Service.
  • Any Content obtained from the Service, including decisions made in reliance on AI-generated analyses.
  • Unauthorized access to or alteration of your data or communications.
  • Any third-party conduct or content on the Service.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the greatest extent permitted by law.

Statutory Rights Preserved

EU/EEA/UK Consumers: Nothing in this section excludes or limits our liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, (c) any liability that cannot be excluded or limited under applicable mandatory consumer protection law, including the Digital Content Directive (2019/770/EU). Your statutory rights remain unaffected.

US Users: Some US states do not allow limitations on implied warranties or exclusion of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply, and you may have additional rights.

Section 12

Indemnification

You agree to indemnify, defend, and hold harmless Viqus.ai, its operators, and contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your violation of these Terms.
  • Your violation of any third-party right, including intellectual property or privacy rights.
  • Your use of the Service in a manner not authorized by these Terms.

EU Consumer Exception: This indemnification clause does not apply to consumers in the EEA or UK to the extent it is incompatible with mandatory consumer protection legislation in the relevant jurisdiction. Where applicable, this provision applies only to professional or business users.

Third-Party Links & Services

The Website may contain links to third-party websites, services, or resources that are not owned or controlled by Viqus.ai. We provide these links for convenience and reference only.

  • We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
  • Inclusion of a link does not imply endorsement, sponsorship, or recommendation by Viqus.ai.
  • We encourage you to review the terms and privacy policies of any third-party websites you visit.

You acknowledge and agree that Viqus.ai shall not be liable for any damage or loss caused by or in connection with the use of any third-party content, goods, or services.

Section 14

Additional EU/EEA Consumer Rights

If you are a consumer resident in the European Economic Area or the United Kingdom, you have the following additional rights and protections:

Right of Withdrawal: Where applicable (e.g., if we introduce paid services), you have the right to withdraw from a distance contract within 14 calendar days without giving any reason, in accordance with Directive 2011/83/EU. We will provide clear withdrawal instructions at the point of purchase.

Digital Content Conformity: Under Directive (EU) 2019/770 (Digital Content Directive), digital content and services must be in conformity with the contract. If the Service does not meet the standards described in these Terms or is not of the quality a reasonable user would expect, you may be entitled to have the issue remedied, to receive a proportionate reduction, or to terminate the contract.

Unfair Contract Terms: Any term in these Terms that is found to be unfair under Directive 93/13/EEC (Unfair Contract Terms Directive) or equivalent national legislation shall be non-binding on you. The remaining terms shall continue in effect.

Online Dispute Resolution: The European Commission provides an Online Dispute Resolution (ODR) platform for consumers in the EU. You can access it at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution but will consider requests in good faith.

Transparency under DSA: In accordance with the EU Digital Services Act (Regulation (EU) 2022/2065, Article 14), these Terms are written in clear and unambiguous language, and we will inform you of any significant changes in advance. Our content moderation practices, if applicable, are described in these Terms.

Section 15

Termination

You may stop using the Service at any time. If you are subscribed to the Newsletter, you may unsubscribe at any time using the link in any email.

We may restrict or terminate your access to the Service if:

  • You materially or repeatedly breach these Terms.
  • We are required to do so by law or court order.
  • Your conduct may cause harm to other users, third parties, or our systems.

Before taking action (except where legally prohibited or in cases of urgency), we will provide you with a statement of reasons and, where practicable, an opportunity to remedy the breach. This is consistent with the transparency requirements of the EU Digital Services Act.

Survival: Sections relating to Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any provisions that by their nature should survive termination will continue in effect after termination of these Terms.

Section 16

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

EU/EEA/UK Consumers: If you are a consumer in the EEA or UK, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your right to rely on such mandatory provisions. Any disputes may be brought before the competent courts of your country of residence, in accordance with Regulation (EU) No 1215/2012 (Brussels I Recast).

US Users: For users in the United States, any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction. Nothing in these Terms constitutes a waiver of your rights under applicable US state consumer protection statutes.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Viqus.ai regarding your use of the Service and supersede all prior agreements, understandings, and communications.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction, provided it does not reduce your rights.
